Terms and Conditions for Accommodation

Article 1 (Scope)

  1. The lodging contracts and any related contracts entered into between this establishment and its guests shall be governed by the provisions of these Terms and Conditions. Matters not specified herein shall be governed by applicable laws and regulations or by generally established customs.
  2. Where this institution has agreed to special terms not contrary to laws, regulations, or established practices, such special terms shall prevail notwithstanding the provisions of the preceding paragraph.

Article 2 (Application for Accommodation Contract)

  1. Persons wishing to apply for a lodging contract at this hotel must provide the following information to the hotel.
    1. Guest Name
    2. Date of stay and estimated arrival time
    3. Accommodation Fees (Based on the basic accommodation rates in Appendix 1, as a general rule.)
    4. Other matters deemed necessary by this institution
  2. If a guest requests to extend their stay beyond the number of nights specified in the preceding paragraph, item 2, during their stay, the hotel shall treat this request as a new application for an accommodation contract at the time the request is made.

Article 3 (Establishment of Accommodation Contract, etc.)

  1. The lodging contract shall be deemed concluded when the hotel accepts the application described in the preceding article. However, this shall not apply if the hotel proves that it did not accept the application.
  2. Upon the establishment of an accommodation contract pursuant to the preceding paragraph, the applicant shall pay the application fee specified by the hotel by the date designated by the hotel, up to the amount of the basic accommodation fee for the accommodation period (or for three days if the period exceeds three days).
  3. The deposit shall first be applied to the final accommodation charges payable by the guest. Should circumstances arise where the provisions of Article 6 and Article 18 apply, the deposit shall be applied in the following order: first to cover any penalty charges, then to cover any compensation. Any remaining balance shall be refunded at the time of payment of charges pursuant to Article 12.
  4. If the application fee specified in Paragraph 2 is not paid by the date designated by the hotel pursuant to the provisions of that paragraph, the lodging contract shall become void. However, this shall apply only if the hotel has notified the guest of the designated payment date for the application fee.

Article 4 (Special Agreement Exempting Payment of Application Fee)

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, this facility may agree to a special arrangement whereby payment of the deposit specified in said paragraph is not required after the contract is concluded.
  2. When accepting an application for an accommodation contract, if the hotel did not request payment of the application fee specified in Paragraph 2 of the preceding article and did not specify a payment deadline for said application fee, it shall be treated as having agreed to the special provision in the preceding paragraph.

Article 5 (Refusal to Enter into Accommodation Contracts)
The hotel may refuse to enter into an accommodation contract in the following cases:

  1. When the lodging reservation does not comply with these terms and conditions.
  2. When there are no available rooms due to full occupancy.
  3. When a person seeking lodging is deemed likely to engage in conduct concerning lodging that violates legal provisions, public order, or public morals.
  4. When a person seeking lodging is determined to fall under any of the following categories:
    ・Organized crime groups as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as “organized crime groups”), organized crime group members as defined in Article 2, Item 6 of the same Act (hereinafter referred to as “organized crime group members”), quasi-members of organized crime groups, persons associated with organized crime groups, or other antisocial forces
    ・When the entity is a corporation or other organization controlled by a violent group or violent group member. ・When a corporation has an officer who qualifies as a violent group member.
  5. When a guest causes significant inconvenience to other guests through their words or actions.
  6. When it is clearly recognized that a person seeking lodging is suffering from a contagious disease.
  7. When violent demands are made regarding lodging, or when burdens exceeding reasonable limits are imposed.
  8. When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances.
  9. When the circumstances fall under the provisions of Article 5 of the Gifu Prefecture Ordinance for the Enforcement of the Hotel Business Act.

Article 6 (Guest’s Right to Cancel the Contract)

  1. Guests may cancel their lodging contract by notifying the hotel.
  2. The hotel shall charge a cancellation fee as set forth in Appendix Table 2 when a guest cancels all or part of the lodging contract for reasons attributable to the guest (except when the hotel has specified a payment date for the deposit under Article 3, Paragraph 2 and requested payment, and the guest cancels the lodging contract before making such payment). However, this shall only apply if the hotel agreed to the special terms under Article 4, Paragraph 1, and only if the hotel notified the guest of the obligation to pay the penalty fee in the event of cancellation when agreeing to those special terms.
  3. If a guest fails to arrive by the afternoon of the scheduled arrival date (or by the time specified in advance if an arrival time has been provided) without prior notification, the hotel may treat the accommodation contract as having been canceled by the guest.

Article 7 (The hotel’s Right to Terminate the Contract)

  1. This hotel may cancel the lodging contract in the following cases:
    1. When a guest is deemed likely to engage in conduct that violates laws and regulations, public order, or public morals in connection with their lodging, or when such conduct is deemed to have occurred.
    2. When a guest is determined to fall under any of the following categories.
      1. Organized crime groups, organized crime group members, quasi-members of organized crime groups, or persons associated with organized crime groups, and other antisocial forces
      2. When the corporation or other organization is controlled by a gang or gang member in its business activities
      3. A corporation whose officers include individuals who are members of organized crime groups
    3. When a guest engages in conduct that causes significant inconvenience to other guests.
    4. When it is clearly recognized that a lodger is an infectious disease patient.
    5. When violent demands are made regarding lodging, or when burdens exceeding reasonable limits are imposed.
    6. When accommodation cannot be provided due to reasons attributable to force majeure such as natural disasters.
    7. When the case falls under the provisions of Article (No. ) of the Prefectural Ordinance.
    8. Smoking in bed in the bedroom, tampering with firefighting equipment, or other violations of the hotel’s usage rules (limited to those necessary for fire prevention).
  2. When this hotel cancels the lodging contract based on the preceding provision, we will not charge for lodging services or other fees that the guest has not yet received.

Article 8 (Accommodation Registration)

  1. Guests are required to register the following information at the front desk on the day of their stay.
    1. Guest name, age, gender, address, and occupation
    2. For foreign nationals: nationality, passport number, port of entry, and date of entry
    3. Departure date and scheduled departure time
    4. Other matters deemed necessary by this institution
  2. When a guest intends to pay the fees specified in Article 12 using methods that can substitute for currency, such as traveler’s checks, accommodation vouchers, or credit cards, they must present these at the time of registration as described in the preceding paragraph.

Article 9 (Room Usage Hours)

  1. Guests may use their rooms from 4:00 PM until 10:00 AM the following morning. However, for consecutive stays, guests may use their rooms throughout the day, excluding the arrival and departure dates.
  2. Notwithstanding the provisions of the preceding paragraph, this hotel may accommodate guest room use outside the hours specified therein. In such cases, the following additional charges will apply.
    1. For up to 2 hours over the allotted time, one-third of the room charge (or 30% of the room charge equivalent)
    2. For up to 4 hours over the allotted time, half the room charge (or 50% of the room charge equivalent)
    3. For over 6 hours, the full room charge (or 100% of the room charge equivalent)
  3. The room charge equivalent amount referred to in the preceding paragraph shall be 70% of the basic accommodation fee.

Article 10 (Compliance with Usage Rules)
Guests shall comply with the usage rules established and posted by the hotel within the hotel premises.

Article 11 (Business Hours)

  1. The operating hours for our main facilities are as follows. Detailed operating hours for other facilities are provided in our brochures, posted notices, and in-room service directories.
    1. Front Desk/Cashier Service Hours: 4:00 PM to 8:00 PM
    2. Ancillary Service Facility Hours: Shared Kitchen Area 4:00 PM to 12:00 AM
    3. Shared Bathroom: 5:00 PM to 12:00 AM (Guests staying in rooms without private bathrooms may use the shared bathroom based on their reservation time. However, use is limited until 12:00 AM.)
  2. The times specified in the preceding paragraph may be temporarily changed when absolutely necessary. In such cases, notification will be provided by appropriate means.

Article 12 (Payment of Fees)

  1. The breakdown of lodging fees and other charges payable by guests shall be as set forth in the attached schedule.
  2. Payment for the accommodation charges and other fees specified in the preceding paragraph shall be made at the front desk upon the guest’s departure or when requested by the hotel, using cash, traveler’s checks, accommodation vouchers, credit cards, or other methods approved by the hotel as substitutes.
  3. Even if a guest chooses not to stay after the hotel has provided the guest room and made it available for use, the accommodation fee will be charged.

Article 13 (Responsibility of the Hotel)

  1. This hotel shall compensate guests for damages incurred in the performance of the lodging contract and related contracts, or due to non-performance thereof. However, this shall not apply if such damages are not attributable to causes for which the hotel is responsible.
  2. This establishment is covered by lodging liability insurance to address unforeseen events such as fire.

Article 14 (Handling When Contracted Rooms Cannot Be Provided)

  1. Should this hotel be unable to provide the contracted guest room to a guest, it shall, with the guest’s consent, arrange alternative lodging at another facility under conditions as similar as possible.
  2. Notwithstanding the preceding paragraph, if this hotel is unable to arrange alternative lodging, it shall pay the guest compensation equivalent to the penalty fee, which shall be applied toward damages. However, no compensation shall be paid if the inability to provide a room is not attributable to this hotel.

Article 15 (Handling of Deposited Items, etc.)

  1. The hotel shall compensate guests for any loss, damage, or destruction of items, cash, or valuables deposited at the front desk, except in cases of force majeure. However, for cash and valuables, if the hotel requested the guest to declare the type and value of such items and the guest failed to do so, the hotel’s liability for damages shall be limited to ¥100,000.
  2. The hotel shall compensate for any loss, damage, or destruction of items, cash, or valuables brought into the hotel by guests and not deposited at the front desk, if such loss, damage, or destruction results from the hotel’s intentional act or negligence.
    However, for items whose type and value were not declared in advance by the guest, the hotel shall compensate for damages up to a maximum of 100,000 yen, except in cases where the hotel acted with intent or gross negligence.

Article 16 (Storage of Guests’ Luggage or Personal Belongings)

  1. If a guest’s luggage arrives at the hotel prior to their check-in, the hotel will store it responsibly only if the hotel has given its prior consent. The luggage will be handed over to the guest at the front desk upon check-in.
  2. After a guest has checked out, if any luggage or personal belongings are left behind at the hotel and the owner is identified, the hotel shall contact the owner and seek their instructions. However, if no instructions are received from the owner or the owner cannot be identified, the items will be stored for seven days including the day of discovery, after which they will be reported to the nearest police station.
  3. The hotel’s liability for the storage of guests’ luggage or personal belongings in the cases described in the preceding two paragraphs shall be governed by the provisions of the preceding article, paragraph 1 in the case described in paragraph 1, and by the provisions of the same article, paragraph 2 in the case described in the preceding paragraph.

Article 17 (Responsibility for Parking)
When guests use the hotel’s parking lot, regardless of whether vehicle keys are deposited, the hotel provides the space but does not assume responsibility for managing the vehicles. However, if damage occurs due to the hotel’s intentional act or negligence in managing the parking lot, the hotel shall be liable for compensation.

Article 18 (Guest Liability)
If the hotel suffers damage due to a guest’s intentional act or negligence, the guest shall compensate the hotel for such damage.

Article 19 (Governing Law and Jurisdiction)

These Terms and Conditions shall be governed by Japanese law. Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

(Note)

  1. These rates are subject to change due to amendments to relevant laws or economic conditions. Infants under 3 years old stay free of charge regardless of whether bedding is provided. Children aged 4 and above who are provided with bedding equivalent to an adult’s will be charged 100% of the adult rate. However, children aged 4 to 5 who do not receive bedding stay free of charge.
